حظر تحليف الشهود اليمين أمام مأموري الضبط القضائي باستثناء هذه الحالة

حظر مشروع قانون الإجراءات الجنائية الجديد، والذي وافقت عليه اللجنة التشريعية بمجلس النواب، نهائيا، تمهيدا لعرضه على الجلسة العامة، على  مأموري الضبط القضائي تحليف الشهود أو الخبراء اليمين، باستثناء حالة واحدة .

ونصت مادة 31 من مشروع القانون على أنه يجوز لمأموري الضبط القضائي أثناء جمع الاستدلالات سماع أقوال من يكون لديهم معلومات عن الوقائع الجنائية ومرتكبيها وسؤال المتهم عن ذلك، ولهم أن يستعينوا بالأطباء وغيرهم من أهل الخبرة ويطلبوا رأيهم شفهياً أو بالكتابة.

ولا يجوز لهم تحليف الشهود أو الخبراء اليمين، إلا إذا خيف ألا يستطاع فيما بعد سماع الشهادة بيمين.

وألزم مشروع قانون الإجراءات الجنائية الجديد، مأموري الضبط القضائي ومرء وسيهم ورجال السلطة العامة ابراز ما يثبت شخصياتهم وصفاتهم عند مباشرة عملهم.

ونصت مادة 27 على أنه يجب على مأموري الضبط القضائي ومرء وسيهم ورجال السلطة العامة أن يبرزوا ما يثبت شخصياتهم وصفاتهم عند مباشرة أي عمل أو إجراء منصوص عليه قانوناً، ولا يترتب على مخالفة هذا الواجب بطلان العمل أو الإجراء وذلك دون إخلال بتوقيع الجزاء التأديبي.

ويعد رجل السلطة العامة في تطبيق أحكام هذا القانون كل شخص منوط به قانوناً المحافظة على النظام والأمن والآداب العامة، وحماية الأرواح والأعراض والأموال وعلى الأخص منع الجرائم وضبطها، وتنفيذ ما تفرضه عليه القوانين واللوائح من واجبات.
