Individuals grapple with their own lives and then proceed to end another’s life, becoming a perpetrator of senseless violence, while the victims’ families suffer profound losses, living with memories and echoes of the departed. **Understanding Murder**

Murder is defined as any act that the law criminalizes and punishes. It encompasses any method or way employed by the perpetrator to kill a victim, whether human or animal. According to Article 452 of the Jordanian Penal Code, killing animals is also classified as a crime, with varying penalties.

**Elements of Murder**

1. **Material Element:** This involves the conduct resulting in the crime, which can be either positive or negative.
– **Positive Conduct:** Actions taken by the perpetrator that lead directly to the crime.
– **Negative Conduct:** Failure to act when required by law. Philosophers and legal scholars have debated whether omissions (negative conduct) can be considered in crimes. While some argue that omission alone cannot cause harm, the prevailing view is that the material element, causing a result, is crucial.

2. **Mental Element:** This concerns the perpetrator’s intent and awareness of the consequences of their actions. For instance, using a knife to stab someone clearly indicates criminal intent. Even if the method of killing varies (e.g., strangulation or poisoning), the intention remains critical. Crimes committed without intent or under different circumstances are treated differently, as outlined in Article 326 of the Jordanian Penal Code, with exceptions for minors and the insane.

3. **Subject of the Crime:** The subject of the crime is always a human. It is illogical to punish an animal for causing death, as the crime’s subject must be a person.

3. **Acts Done Without Awareness or Will:** Article 74 states that no one is punished unless the act was done with awareness and intention.
4. **Ignorance of the Law:** Article 85 clarifies that ignorance of the law is not an excuse for committing a crime.
5. **Coerced Actions:** Article 74 states that there is no penalty for crimes committed under coercion or threat.
